When I set a real fullscreen resolution (1024x768) go fullscreen and hit Esc for the menu bar to appear
the emulator switches back to windows mode to show the menu bar.

Is there any way to fix this so the menu bar will appear in real fullscreen.

No, that is only possible if you use directdraw. For d3d and ogl you'll have to use emulated fullscreen.
